Slate Claims Making Child Porn is a First Amendment Right

On Wednesday, Oct. 28, at noon Eastern, the Free Speech Project will host an hourlong online event titled Do We Need a First Amendment 2.0? For more information and to RSVP, visit the New America website.

When I was finishing up law school in 1990 at the University of Texas, there was nothing I wanted more than to clerk for Judge Marvin Odell Teague. As a member of the Texas Court of Criminal Appeals, Teague produced more than 1,000 of the best-written, funniest opinions I’ve ever read. His barbed dissents had the flash of the late Justice Antonin Scalia’s: “Today, we witness the bastard child that two judges of this Court gave birth to in Woodward v. State, 668 S.W.2d 337 (Tex.Cr.App.1982), reaching puberty,” he remarked in one 1984 case. “It will be most interesting to see what the bastard child looks like when it reaches full manhood.” He was dissenting in that case, he explained, because “I am unable to agree that this Court should buy the damaged and unrepairable merchandise the State is selling in this cause, namely, appellant’s confession.” Which is to say, Teague was more spiritually generous than Scalia—and almost always more pro-defendant. I won an interview with him, which was vastly entertaining in itself, but didn’t get the spot. He died less than a year later, at the far-too-young age of 57.

In an alternate universe, Teague—born just a few months after Ruth Bader Ginsburg in 1933—might have lived long enough to hear an appeal of Texas’ prosecution, announced just this week, of Netflix for its streaming of the French film Mignonnes (Cuties in the U.S.). Netflix was charged with “promotion of lewd visual material depicting a child” by a grand jury at the direction of Tyler County District Attorney Lucas Babin. Babin’s biggest previous claim to fame is his portrayal of the invariably bare-chested guitarist “Spider” in fellow Texan Richard Linklater’s The School of Rock. In the Linklater film, child actors playing precocious prep-school student musicians—who regularly upstage star Jack Black—share more than a few traits with the entrepreneurially competitive 11-year-old protagonists of Cuties.

Australia: Pregnant Woman Arrested in Her Home Over Anti-Lockdown FB Post

Shocking video footage out of Melbourne, Australia shows a pregnant woman being arrested in front of her children in her own home for the ‘crime’ of organizing an anti-lockdown protest on Facebook.

The clip shows police entering the woman’s house and presenting her and her husband with a search warrant.

The woman is then told she is under arrest in relation to “incitement” before being handcuffed.

She explains that she is pregnant and has an ultrasound in an hour, but officers are undeterred, telling her she is being arrested for a Facebook post in which she organized an anti-lockdown protest

Majority of Conservatives Say They ‘Self Censor’ to Avoid Upsetting Leftists

A survey conducted by College Fix recently has found that a majority of conservative students say they will ‘self censor’ around others so as not to offend or upset leftists.

“With the current political climate, do you expect to self-censor yourself in class this semester so your professors or peers don’t take offense at your ideas?” the survey asked.

A total of 54 percent of conservatives said they would indeed keep their political views to themselves for this reason.

On the flip side, only 15% of those who identified as Democrats said they would temper their political opinions so as not to cause friction.

Prof Retires After University Publicly Condemns ‘Vile’ Tweets Criticizing BLM, Lockdowns

A North Carolina professor has retired after the University of North Carolina-Wilmington publicly condemned his tweets criticizing coronavirus lockdowns and disparaging “women’s studies” programs as “non essential.”

UNC-Wilmington students and professors rallied against criminology and sociology professor Mike Adams, calling for him to be fired after several of Adams’ social media posts were condemned by the school as “vile and inexcusable.”

“We can confirm we are very carefully and assertively reviewing our options in terms of how to proceed. We are not able to comment further at this time, as this is a personnel matter,” the university told CNN before announcing on June 29 that “after a discussion with Chancellor Sartarelli, Dr. Adams has decided to retire from UNCW.”

Federal Judge: Cuomo, de Blasio Violated Religious Freedom

pieces of shit

U.S. District Judge Gary L. Sharpe handed down a preliminary injunction on Friday against New York officials for violating the First Amendment by shutting down religious services while encouraging Black Lives Matter protests.

Earlier this month, two Catholic priests and three Orthodox Jews came together in a lawsuit against New York Gov. Andrew Cuomo, New York Attorney General Letitia James, and New York City Mayor Bill de Blasio, alleging that Democrats were violating their religious liberty under the First Amendment (and the Equal Protection Clause of the Fourteenth Amendment) by discouraging religious gatherings while joining large crowds of protesters in the streets.

Twitter Suspends Malkin Amid Leftist Violence Despite Trump’s Big Tech Order

Twitter has suspended Michelle Malkin for a tweet that argued that “violent criminal looters” should be shot, and is demanding she remove it.

Malkin, the conservative and pro-America First political commentator, had written on Twitter as the recent Black Lives Matter riots first spread around the country that “violent criminal looters should be shot.”

Five days after posting the initial tweet, Twitter decided that Malkin’s comments violate their rules against “abuse and harassment,” and have demanded that she delete the tweet. If she does, a 12 hour countdown will begin before she is no longer suspended from the platform.

Church burnt down for ignoring lockdown rules

“Bet you stay home now you hypokrits [sic],” read the misspelled graffiti outside of a burnt down church in Mississippi.

That graffiti, of course, is suspected to have come from the unidentified arsonist. The motive: the church ignored the city’s lockdown rules, and continued holding services.

This same church sued the city of Holly Springs over the lockdowns after being cited for holding mass despite city restrictions on how many people could gather, and non-essential businesses.

Trump to Finally Crack Down on Big Tech Censorship With Executive Order

U.S. President Donald Trump will sign an executive order shortly regarding social media companies, a White House spokeswoman said on Wednesday.

Spokeswoman Kayleigh McEnany made the remark to reporters aboard Air Force One, traveling with Trump to Washington from Florida a day after Twitter Inc attached a warning to some of his tweets prompting readers to fact-check the president’s claims.

Federal Appeals Court Asked to Stop Mayor de Blasio’s Restriction on First Amendment

Late yesterday, the American Freedom Law Center (AFLC), a national public interest law firm, filed an emergency motion for an injunction pending appeal in the U.S. Court of Appeals for the Second Circuit against New York City Mayor Bill de Blasio and his police commissioner.

The AFLC-filed motion asks the federal appellate court to immediately reverse Judge Denise Cote’s recent order refusing to issue an immediate injunction forbidding Mayor de Blasio and the New York City Police Department from preventing public group protests in the City.

The underlying lawsuit, which was filed on behalf of political activist Pamela Geller, challenges Mayor de Blasio’s recent announcement that, pursuant to his executive orders, the First Amendment no longer applies in the City of New York as he has made it unlawful to peaceably assemble and protest.

Immediately after filing the lawsuit, AFLC filed a motion seeking a temporary restraining order and preliminary injunction to permit organized public protests that abide by social distancing and face mask requirements.  Oral argument was heard on that motion last Friday via videoconferencing, but the judge refused to grant the injunction.  On Monday, the judge issued her order denying the TRO and entered a final judgment dismissing the lawsuit so AFLC could file an expedited appeal on behalf of Ms. Geller.

NY Mayor De Blasio Arrests Peaceful Patriots, Protects Antisemitic Protest

The tyrannical NYC Mayor has imposed a ban on our first amendment right to protest. We have filed a lawsuit against the Mayor and NYPD Commision for this blatant violation of our first amednement rights.

Enforcement is selective.

This past weekend, De Blasio arrested peaceful patriots.

Nine protesters pushing for the Empire State to reopen from its coronavirus lockdown were busted Saturday afternoon outside City Hall, for not obeying social distancing guidelines, sources told The Post.

But when jihad spokesperson Jew hater and terror spox Linda Sarsour held a protest against a non existent stop and frisk policy. She was given the royal treatment.

We will be in court on Friday.
